CODE OF ETHICS                                Constitution & Rules

 
 

Maintenance of the reputation of the Association and of the high standard of ethical practice which it promulgated is the direct responsibility of every member.

The confidential and trustworthy nature of an agent's work makes it a matter of public concern that the reputation of members, for integrity and efficiency should be beyond question. The prestige of any professional body depends to a very great extent upon the ethical standards observed by its individual members, both in their association with one another and in their relationships with the community in general . It is therefore the duty of every member to conduct his affairs in a manner that will not be of deterrent to the reputation of the profession.

Article 1  In accepting the agency for businesses, a Member pledges himself to be fair to the customer as well as the clients whom he represents, whose interests he should protect and promote as he would his own.

Article 2  In justice to those who seek his services, a member should endeavour to be informed always regarding the law, proposed legislation and other essential facts, and public policies which affect those interests.

Article 3  A member's relationship with his/her client or customer should always be considered confidential.

Article 4  Business should be offered by the member solely on its merit, without exaggeration, concealment or any form of deception or misleading representation.

Article 5  It is the duty of a member to ascertain all available pertinent facts concerning the business for which he accepts the agency, so that in offering the business he avoids misrepresentation,

Article 6  The price at which a member offers a business should not be higher or lower than that which the owner has openly agreed to take. (12)

Article 7  A member should not buy for himself businesses listed with him, nor should he acquire any interest therein, without first making his true position clearly known to the client nor should a member sell his own property to a client or customer who has retained his services without the client's/customer's knowledge and consent in each case.

Article 8  It is the duty of every member to protect the public against fraud, misrepresentation or unethical practices in connection with a business transaction.

Article 9  In the best interest of society, his associates, and of his own business, a member should be loyal and active in his work, and he should willingly share with his fellow members the lessons of his experience.

Article 10  A member should so conduct his business as to avoid controversies with his fellow agents., but in the event of a controversy between members of the Association such controversy should be submitted for arbitration in accordance With the rules previously outlined and not to be a suit at law. The decisions in such arbitration shall be accepted as final and binding.

Article 11  A Member shall never publicly criticize a fellow-member.

Article 12  Should a prospective buyer express interest in a business offered by a competitor, the member shall treat the proposition, as well as the absent Agent, with fairness and in accordance with strict professional courtesy and integrity.

Article 13  When a member is charged with unethical practice he shall voluntarily place all pertinent facts before the proper tribunal of the Association for investigation and judgment

Article 14  A member cannot honorably seek information about a transaction of a fellow-member and make use of the knowledge for the purpose of closing the transaction himself

Article 15  Members, may recommend and earnestly encourage owners to practice the granting of Exclusive Agency contracts with members.

Article 16  All negotiations must be conducted through the Listing Broker.

Article 17  When called upon to make a valuation of a business or give an opinion on a business problem, a member is expected to give a considerate answer, his counsel constitutes a professional service and he should, therefore, carefully ascertain and weigh the available facts. This service entitles him to make a professional charge.

Article 18  A member should not solicit the services of any employee in the organisation of a fellow-member without the knowledge of the employer.

Article 19  No instructions nor inducements from any clients or customers should relieve the member from his responsibility strictly to observe these Code of Ethics, (13)

Article 20  All members must abide by the Rules and Codes of conduct imposed upon by the Act.
